Submission Agreement

By submitting your entry for the 2007 MAX Awards you agree as follows:

You are the original developer of the submitted project, including, but not limited to, the material, text, data, and other works of authorship used in the submitted project.
You will indemnify and hold Adobe harmless from any claim related to the submitted project, including any claim by a third party that your project infringes any copyright, patent, trademark, trade secret, rights of privacy or publicity, or any other intellectual-property right.
You represent and warrant that you have the authority to agree to the terms contained herein.
You agree to be bound by the Official Rules located at http://adobemax2007.com/awards/rules/.

If the submission is selected as a category winner, you agree to have your company included in an Adobe press release announcing the winners, including a short description of the project. Note: Adobe is not obligated to use any winners in a press release.

If the submission is selected as a category finalist, a representative must attend any and all pre-event meetings (by phone or in person) as well as attend the MAX 2007 event in person to be held in Chicago, Illinois, USA, from September 30 - October 3, 2007. If the submission is selected as a finalist or other distinction (i.e. Honorable Mention) you agree: (i) to grant Adobe a worldwide, nonexclusive, royalty-free right to publicly perform and display the submitted project on the Adobe website and event and marketing materials; and (ii) to provide additional content to highlight on the Adobe website including logo, screen captures (or access to the application in order to capture high-resolution images), a short presentation, any additional visuals, and complete an Adobe Acrobat Connect recording prior to the MAX 2007 Event.

Adobe reserves the right, in its sole discretion, to refuse the submitted project.

IF YOU DO NOT AGREE TO THE PRECEDING, OR IF YOU DO NOT OWN OR HAVE RIGHTS TO EVERY ELEMENT OF THE SUBMITTED PROJECT, DO NOT SUBMIT THE PROJECT AS A CANDIDATE FOR A 2007 MAX AWARD. YOU WILL BE FINANCIALLY LIABLE TO ANY THIRD PARTY THAT OWNS ANY ELEMENT OF THE SUBMITTED PROJECT.
